What does an online parenting mediation cover?

​An online parenting mediation can cover all the topics that are covered in a face to face mediation. Through an online parenting mediation we can help parents reach agreements on weekday and weekend contact schedules, decision-making responsibility (education, health, major life choices), changeover arrangements and flexibility and what happens on key dates (e.g. special occasions and birthdays).

Can this service help if my ex is withholding the children or cancelling time at the last minute?

Family dispute resolution is designed to help separated parents discuss issues such as denied contact, changes to changeover times and disagreements about where children spend time  Mediation cannot force a parent to comply, but it can provide a structured, child-focused conversation to try to resolve these disputes quickly and reduce the need for court.

What does an online property mediation cover?

​An online property mediation can cover all the topics that are covered in a face to face mediation. Our property mediation can help couples reach a just and equitable​ division of property including:

  • The family home (sale, buyout, or co-ownership)

  • Savings, bank accounts and investments

  • Business or farm assets

  • Superannuation

  • Debts (mortgages, personal loans, credit cards)

How quickly can an online mediation be organised?

Private FDR services can typically arrange intakes and joint sessions faster than community agencies. Timeframes still depend on both parents completing their individual consultations and on available session times, but we can priortise urgent matters.

What if we reach agreement in mediation – what happens next?

If you reach agreement about Christmas, New Year or school holiday arrangements, the mediator can help you record the terms in a written parenting plan or summary. You will usually be encouraged to seek independent legal advice about whether to keep it as a parenting plan or apply for consent orders if you want a more formal, enforceable arrangement.

What if we do not reach agreement?

Not all mediations end in full agreement, especially when there are long-running conflicts about Christmas or holiday time. If agreement is not reached, the mediator may discuss other options, which can include issuing a Section 60I certificate where appropriate so you can consider legal avenues with a family lawyer.

Are agreements reached in mediation legally enforceable?

Outcomes from family dispute resolution are not automatically legally enforceable. Any parenting agreement reached in mediation is usually documented in a parenting plan or written agreement, which relies on the goodwill of both parents to follow it. If you want a binding outcome, you generally need to obtain legal advice about turning the agreement into consent orders filed with the court.

 

Will I get a Section 60I certificate from this mediation?

Section 60I certificates are not issued as a matter of course. An FDR practitioner may issue a certificate only in specific circumstances set out in the Family Law Act, such as if one party refuses to attend, the matter is assessed as unsuitable, or mediation does not result in agreement. Whether a certificate is issued will depend on your individual situation and the practitioner's professional assessment.
