Property mediation is a structured process that gives separating couples the opportunity to resolve issues relating to the division of their assets and finances. It’s a form of family dispute resolution encouraged under Australian family law.

Property mediation fees

 

Fixed fees with no hidden costs. A mediation consultation is $350 ex GST per party (up to 90 minutes, in person or online). Property mediation sessions start at $1,000 ex GST per party for a half day (which is typically enough time). There may be some room hire costs for in-person sessions but any such additional fees are confirmed before any session begins.

Mediation typically costs a fraction of what parties spend resolving property disputes through lawyers or court. Most matters are resolved in one to two sessions.

No, you do not need lawyers present to mediate. Many couples mediate first, then have any agreement reviewed independently before it is formalised. If you prefer, lawyer-assisted mediation is also available, where each party's lawyer attends to advise during the session.

 

Who pays for property mediation?

Fees are charged per person, so each party pays their own share of the consultation and session fees. Any shared costs, such as room hire, are split and confirmed in advance.

 

Is property mediation legally binding?

Mediation itself is not legally binding, but the agreement you reach can be made binding. You can formalise it through consent orders filed with the court, or a binding financial agreement prepared with legal advice.
